Council of Ministers. Created an independent body to resolve appeals against the award of public contracts


The Government submit to Parliament the draft Law on Amendments to the Law on Public Sector Contracts providing for the establishment of Central Administrative Tribunal Contract Resources, responsible for resolving appeals against acts of entities linked to the General State Administration. The Council of Ministers also approved the distribution of 70 million euros for the reception and integration of immigrants, and the inclusion of athletes to the Security Forces of the State.


The new law regulates the nature and characteristics of independent bodies should meet to hear appeals by individuals against the acts of the entities within the processes of public procurement, whether they belong in the public sector, as if are private entities that enjoy special or exclusive rights and operate in the sectors of water, energy, transport and postal services.

Under the provisions of the EU directive, the Autonomous Communities may regulate its own body in actions arising in their own recruitment processes, although the Bill also allows the possibility of voluntarily entrusted the resolution of them to the Central Administrative Tribunal. In the case of local corporations, the claims arising from their recruitment processes will be resolved, or in autonomous bodies constituted for that purpose, or in the Central Administrative Tribunal if the Autonomous Community to decide so.

The Court shall, both in actions brought against decisions of the entities of contracts, as interim measures as may be necessary for procedure for the award during the period of their resolution.

Reception and integration of immigrants

The Council of Ministers has agreed to formalize the goals and credit allocation budget of seventy million from the Fund for Support to the reception and integration of immigrants, as well as educational support thereof, pursuant to the provisions of General Appropriations Act.

This allocation will fund the actions that make the autonomous communities to encourage the development of integration policies for immigrants in the following areas: housing, integration into employment axes housing, social services, health, children and youth, equal treatment, women, participation, awareness and development, and educational reinforcement.

The role of government in the field of integration policies for immigrants is limited by the Spanish Constitution, which places the exclusive competence regarding immigration and the Autonomous Communities and local authorities powers in key areas for integration such as employment, education, health, social services or civic participation.

Distribution Criteria:

• 41,208,600 euros for Reception and Integration.
• Strengthening Educational EUR 27,472,400.
• Attention to 1.319 million euros for unaccompanied foreign minors under the Special Programme for the care of unaccompanied migrant children displaced from the Canaries.

High-level athlete in the Security Forces

The Council of Ministers approved a Royal Decree that regulates and evaluates the condition of high level athletes as grounds for access to the Security Forces of the State. This agreement is directly related to one of the objectives of the Sports Act, which establishes a series of measures to enable high-level athletes an easy entry into the labor market during his career and at the end of it. On the other hand, the Royal Decree of 13 July 2007 on high-level athletes and high performance, provides the fundamental framework of recognition of this merit to all government (General State Administration, Autonomous Regions, Local Bodies) and other public institutions.

The decree aims to realize this measure to the scope of the Security Forces of the State, combining the evaluation criteria of merit in the fields of police and Civil Guard. It also establishes a schedule to be implemented in the entrance exam to the National Police and Civil Guards Corps as is provided in the assessment of merit and providing jobs in both bodies.
